1. Who we are

Qwickhose is a brand of Qwickhose Limited, a company registered in England and Wales (company number 05087893). Registered office: The Barn (Unit 3), Manor Farm Office Village, Flexford Road, North Baddesley, SO52 9DF, United Kingdom. VAT number: GB883904488. Our website is https://www.qwickhose.co.uk.

These Terms of Service govern your use of our website and the purchase of products from us. By accessing our site or placing an order you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the site.

You must be 18 or over to purchase.

Nothing in these Terms affects your statutory rights. If you live in the EEA, you can also use the European Commission’s ODR platform.

 

2. Your account and information

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. We may refuse service, close accounts, or cancel orders if we reasonably suspect misuse or fraud.

 

3. Products, pricing and VAT

We take care to describe and show products accurately. Colours and finishes can vary due to device settings.

Prices shown to UK customers are inclusive of VAT where applicable and exclusive of delivery charges unless stated otherwise. Delivery costs are shown clearly before you place your order.

We may change prices and promotions at any time before your order is accepted. We reserve the right to correct obvious pricing errors; such errors will not be binding.

For orders delivered outside the UK, local taxes, duties, and handling fees may be payable by you.

 

4. Orders and acceptance

Your order is an offer to buy. We will send an email acknowledging receipt. A contract is formed only when we email you to confirm dispatch. If we cannot accept your order, we will refund any payment taken.

We may refuse or cancel an order, for example if a product is out of stock, a pricing or description error occurs, we cannot obtain payment authorisation, or there are reasonable concerns about fraud.

We may place limits on purchases per customer and may refuse orders that appear to be placed by resellers, distributors or for export.

If you place a pre-order or backorder, the dispatch date is an estimate only. If we cannot supply within the estimated window, we will notify you and you may cancel for a full refund.

 

5. Payment

We accept the payment methods shown at checkout. You confirm you are authorised to use the chosen method and that details provided are correct.

Depending on the method, payment may be taken on order or on dispatch. We may run checks to verify identity, prevent fraud and confirm payment authorisation. If authorisation fails or fraud is suspected, we may cancel the order.

 

6. Delivery, risk and title

Delivery options and target timeframes are shown at checkout and on our Delivery Policy page. If no delivery date is agreed, we will deliver within 30 days of order acceptance.

Risk in the goods passes to you when the goods are delivered to you, or to a carrier arranged by you. Title passes when we receive full payment.

If you ask us or the carrier to leave the parcel in a safe place or with a neighbour, delivery is completed when left at that location.

We may deliver in instalments; each instalment is a separate contract and a delay in one does not entitle you to cancel the others.

If delivery is delayed by an event outside our control, we will contact you with a new estimate. You may cancel an order that has not been delivered within the statutory timeframe and receive a refund.

 

7. Your right to cancel (UK consumers)

If you buy as a consumer online or by phone, you have a legal right to cancel within 14 days of delivery without giving any reason.

To cancel, tell us clearly within 14 days (email, contact form or post). You can use our model cancellation form [link], but you don’t have to.

You must send the goods back within 14 days of telling us you are cancelling. You are responsible for the cost of return unless the item is faulty, not as described, or we agree otherwise.

We will refund the price you paid, including the standard delivery cost, within 14 days of receiving the goods back or of receiving evidence that you have sent them back, whichever is sooner.

Please return items unused where reasonably possible and take care when inspecting. We may deduct for any loss of value resulting from unnecessary handling beyond what is needed to establish the nature, characteristics and functioning of the goods.

Your statutory rights for faulty or misdescribed goods are not affected. See our Guarantee Statement & Returns & Refund Policy pages for practical details.

Exclusions: The right to cancel does not apply to goods made to your specification or clearly personalised, or where another statutory exception applies.

 

8. Faulty or misdescribed goods

We are under a legal duty to supply goods that are in conformity with the contract.

If a product is faulty, misdescribed, or does not meet statutory standards under the Consumer Rights Act 2015, contact us and we will arrange repair, replacement, or refund as appropriate.

Depending on the circumstances, you may be entitled to a repair or replacement, or a price reduction or refund. Contact us promptly with photos or video where helpful so we can diagnose and resolve quickly.

 

9. Promos, bundles and discount codes

Promotions apply to qualifying products only and may have minimum spend, time limits or stock limits.

Unless stated otherwise, promotions cannot be combined and do not apply to past purchases. If you return items purchased with a promotion, we may adjust the refund to reflect any promotional benefits retained.

 

9A. Errors, inaccuracies and availability

From time to time there may be information on our site that contains typographical errors, inaccuracies or omissions (including descriptions, pricing, availability and shipping charges).

We may correct these and change or update information at any time before acceptance of your order. All products are subject to availability.

 

10. Intellectual property

All content on our site including text, graphics, logos, images, video, and the Qwickhose name and marks are owned by Qwickhose Limited or our licensors.

You may use the site for personal, non-commercial purposes. No licence to use our IP is granted except as necessary to view and buy our products.

 

11. Reviews and user content

If you submit reviews, photos, videos, questions or other content, you grant us a worldwide, royalty-free, perpetual licence to use, host, reproduce, modify and publish that content to operate, improve and promote our products and services, including on our website, emails and social channels.

You confirm you own the content or have permission to share it and that it is lawful and not misleading.

If you were offered an incentive (e.g. discount or freebie) to leave a review, you must disclose that in your review. You grant us a non-exclusive licence to use your display name with your content.

We may moderate, edit or remove content that breaches these Terms or our policies.

 

12. Acceptable use

You agree not to misuse the site, attempt unauthorised access, introduce malicious code, scrape content, or use the site in a way that infringes rights or the law.

You must not use bots, scrapers or automated means to access the site without our prior written permission.

We may suspend or terminate access if you breach this section.

 

13. Third-party services and links

Our store is hosted on Shopify and uses third-party apps and services. Their terms and privacy practices apply where you use them. Links on our site may lead to other websites that we do not control. We are not responsible for their content or policies.

Relationship with Shopify: Sales are made by Qwickhose Limited. Shopify is not a party to your purchase and is not responsible for our products or any resulting claims.

Where an app or service is offered by a third party (for example reviews, loyalty or shipping protection), your use of that feature may be subject to that provider’s own terms, which form a separate agreement between you and that provider.

 

14. Data protection summary

Qwickhose Limited is the data controller for personal data processed in connection with your orders and account. Shopify acts as a processor and service provider that hosts our store and processes data on our behalf.

We rely on lawful bases such as contract, legitimate interests, consent and legal obligations. Where personal data is transferred outside the UK or EEA, appropriate safeguards such as Standard Contractual Clauses are used.

15. Force majeure

We are not responsible for delay or failure to perform due to events beyond our reasonable control, including supplier failures, transport disruption, strikes, epidemics, extreme weather, or law changes.

If an event continues for more than 30 days and materially affects your order, you may cancel any affected items for a refund of amounts paid for undelivered goods.

 

16. Our responsibility to you

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

We do not exclude or limit liability where it would be unlawful to do so, and nothing affects your statutory rights.

Subject to the above, we are not liable for losses that were not reasonably foreseeable when the contract was formed, and we do not compensate for business losses. For each order, our total liability to you for any claim relating to that order will be limited to the amount you paid for the products in that order.


17. Electronic communications

We will communicate with you by email and by posting notices on our site. You agree that these electronic communications satisfy any legal requirement that such communications be in writing.


18. Assignment

You may not assign or transfer your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations to another organisation. This will not affect your rights under the contract.

 

19. Severance and waiver

If any part of these Terms is found unlawful or unenforceable, the rest remains in force. A delay in enforcing rights does not waive them.

 

20. Entire agreement

These Terms, together with the policies and information referenced in them, form the entire agreement between you and us for the purchase of products. Nothing in this section limits or excludes liability for fraud or affects your statutory rights.

 

21. Governing law and jurisdiction

These Terms and any dispute or claim are governed by the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may bring proceedings in your local courts. If you are an EEA consumer, you may have rights to bring claims in your home jurisdiction. Mandatory consumer protections under your local law remain unaffected.

 

22. Personal use only

Products are sold for personal/household use. Commercial resale is not permitted without our prior written consent.
